The Supreme Court has told lower courts to re-evaluate the question of whether a little Virginia patent holder should be allowed to enjoin eBay from using the "Buy It Now" feature. The important point is that the patent holder now has much less ammunition for settlement negotiations: it can demand a reasonable royalty, but it cannot as credibly threaten to freeze the eBay site for any period of time.
