Non-compete agreements are an important tool for employers seeking to protect their trade secrets. But courts will not enforce non-competes unless they protect a legitimate business interest and are reasonable in scope. Where the purpose of an agreement is to protect against competition itself, or where the restrictions on the employee's post-separation activity are unreasonably broad, a court will refuse to enforce the agreement as written.
