UNUSUAL DYNAMIC IN THE IRISH COMMERCIAL PROPERTY MARKET

Encouraging levels of activity continue to be recorded in the occupier sectors of the commercial property market in Ireland and the number of properties being brought to the market has increased in recent months. However, despite the fact that property values are now showing signs of stabilising, activity in the investment sector of the Irish market remains disappointingly weak, with potential investors holding off making investment decisions, primarily as a result of the uncertainty prevailing regarding Government proposals to retrospectively review rent clauses in all business leases.

Irish Election Proposals to Amend Rent Clauses in Business Leases

A ban on upwardly only rent review clauses was introduced in Ireland under section 132 of the Land and Conveyancing Law Reform Act which came into operation last year. Under this legislation, upward only review clauses are banned in all new leases signed since February 28th 2010 but existing lease contracts that contain the upward only mechanism remained intact. With a general election due to take place on February 25th 2011, the manifestos of two parties Fine Gael and Labour expressly state that they will look at retrospectively banning upward only rent reviews in existing business leases if they get into power.The implications of such a proposal will have very significant impacts for the Irish economy.

Following the acres of newsprint that have materialised following the establishment in Ireland of the National Asset Management Agency (NAMA), one would be forgiven for assuming that Ireland is the only country in Europe to experience an economic or property market downturn or have issues with problem debt and levels of impairment. In fact, despite the very significant downturn experienced in the Irish market, it is facing similar problems to many other countries.

While transactional activity in the Irish commercial property market is still performing below capacity, activity in all sectors of the market is up on a quarterly and on an annual basis. Prime rents and yields have now firmly stabilised and total returns from Irish commercial property in Q1 2010 were positive for the first time in over two years which is encouraging.
