Council Member Biography

Louis B. Buchman is a Partner in the Paris office of Field Fisher Waterhouse where he specializes in European and French antitrust, corporate law, arbitration and ADR and the listing of Financial Instruments in Paris. Regarding antitrust issues, Mr. Buchman is able to discuss antitrust review by the European Commission or the French national regulator and advice on commitments to be made in a takeover context. On insolvency issues, he has represented shareholders in the largest cross border bank default before the French courts. Further, as a litigator and arbitrator, Mr. Buchman is involved in disputes relating to minority shareholders claims or regulatory non-compliance claims. Mr. Buchman is also on several international arbitration and mediation panels and a Fellow of the Chartered Institute of Arbitrators. He is the author of several publications, notably on Corporate Governance and on Arbitration. (This is me - Update Profile)

Insider trading in France is a felony giving rise to 2 possible actions, one at the Financial Markets watchdog agency level (AMF), the other in court. Case law is scarce but precedents exist. The outcome of the AMF action will not mean the end of the criminal investigation phase, and has no direct bearing on the eventual outcome of a court case.
