Council Member Biography

Mark Berman is a Partner at Nixon Peabody LLP, resident in its New York City and Boston offices. He is a bankruptcy attorney who also supports the Firm's securitization, leveraged finance, sports and entertainment, infrastructure and public finance practices by applying his bankruptcy expertise to their transactional efforts. For over 37 years, Mr. Berman has represented virtually every kind of interest that might be involved with a financially troubled business or individual. In supporting the transactional efforts, Mr. Berman anticipates issues that might arise should another party to the transaction become insolvent and assists in structuring the transaction, disclosure materials, working with rating agencies and delivering bankruptcy opinions. His work has included various project financings including stadiums, malls, military housing, gas prepay facilities and fertilizer plants, as well as the securitization of tobacco settlement proceeds, trade and lease receivables. Mr. Berman regularly writes and speaks on bankruptcy, commercial and public finance law subjects and has co-authored a handbook on Second Lien Financing and Intercreditor Agreements published by the American Bankruptcy Institute. He received his BA from Northwestern University, his JD from Boston College Law School and is a Fellow in the American College of Bankruptcy. He is a Facilitator with the National Association of Credit Management and a Finance Law Advisory Board Member for Strafford Publications. He has previously taught a class (Introduction to Law) at Brandeis University as a Fellow for two years. (This is me - Update Profile)
