Matthew Murphy is the Managing Director of the MMLC Group in Beijing. Prior to founding the MMLC Group, Mr. Murphy was part of the China and M&A teams at Freshfields Bruckhaus Deringer and led the Asian IP/IT group out of Hong Kong. He specializes in intellectual property, technology, dispute resolution and corporate law. Mr. Murphy is a Panelist in the Hong Kong International Arbitration Centre and in the gTLD Asian Domain Name Dispute Resolution Centre. He is particularly active in international and China patent, trademark and copyright disputes, as well as cross-border restructurings, Asian M&A (including competition law), and general complex international commercial dispute resolution. This article looks at a recent Chinese court decision which extended the application of Article 253 of the PRC Criminal Law to common citizens in China. Until this decision was issued, come commentators had thought that Article 253 was limited to the actions of employees of state agencies involved in special sectors, such as the telecoms sector. This article also provides a general overview of the various laws that can be used to protect privacy in China.
